New York lawmakers wash their hands of daily fantasy sports

A recent court ruling has forced the New York Gaming Commission to relieve itself of its supervisory role over daily fantasy sports (DFS).
According to a New York Supreme Court ruling in October, the state’s legislators exceeded their authority with their 2016 legislation that defined daily fantasy sports as a game of skill instead of amending the state constitution to add DFS as a legal form of gambling.
A report by the Buffalo News last Monday said the NYGC has scrapped all mentions of DFS from its website.
A spokesperson for the commission, Brad Maione, said the commission “no longer has a role in regulating DFS. That required a modification of the website.”
Per the ruling DFS operators in the state can continue to offer services to their clients by just upholding the section of the 2016 law that decriminalised DFS.
The ruling makes New York-based DFS operators currently not subjected to any state regulations and therefore cannot face any criminal charges for offering state residents DFS.
In a statement, FanDuel expressed its willingness to “cooperate with efforts to permanently restore regulatory oversight”. The company emphasised that it continues to operate in New York and is not subjected to any breaches of state laws or regulation.
The attorney for anti-gambling plaintiffs, Cornelius Murray, said his clients might go back to court to challenge the ruling.
The state has until December 2, to enter an appeal, however officials are undecided on whether or not they will file an appeal.
